By making a purchase from Cush's Sketch Portraits, whether through the online shop, invoicing, bank transfer, or any other payment method, you are agreeing to the terms and conditions laid out here.
As a wildlife artist, I strive to achieve excellent customer service and want to make each commission, including commissioned artwork and custom pet portraits an easy and enjoyable experience. Although most commissions are completed as expected, I will always be available to help should any issues arise.
I may turn down commissions if I feel it would be inappropriate to carry out a specific request, or if I believe I cannot meet the client's expectations.
All copyright and reproduction rights are reserved by the artist of any commissioned artwork, including custom pet portraits and other creations. By commissioning from me, you grant me the rights to your photo(s) to produce this artwork. You also allow me to display the commissioned artwork in various forms, such as on advertisements, my website, and all social media pages. If you prefer that I do not feature your commissioned artwork on social media and/or my website, you must inform me of this request before booking, as I may wish to decline your commission. If you are comfortable with me publishing your artwork online but would like it to be shared only after a specific date, such as a birthday, please let me know and I would be more than happy to oblige.
By getting booked in for your custom pet portrait, you agree that there is no deadline for the completion of your commissioned artwork. You will be added to the waiting list, and your portrait will be started once all commissioned work booked in prior to yours has been completed, however long that takes. I will be able to give you an idea of the expected completion date at the time of booking, and the project is not likely to exceed six months.
All purchases for commissioned artwork are non-refundable, including the 20% deposit once a drawing has been set up or started. If you have paid a deposit for a custom pet portrait and wish to cancel your booking (except under the above condition) or choose not to receive the completed portrait, you will not be entitled to a partial or full refund. Should you decide against completing your purchase after paying a deposit, you will forfeit your portrait and will not receive any refund. Your artwork will be securely stored for 12 months in case you change your mind. After 12 months, the artwork will become my property. In the unlikely event that I cannot fulfill your commission, you are entitled to a full refund of any amounts paid. Refunds will be processed in the same manner as the original payment.
Cush's Sketch Portraits specializes in commissioned artwork and offers worldwide shipping for your custom pet portraits. Please ensure you accurately write your full address. If an incorrect shipping address is provided and your portrait is delivered to that address, Cush's Sketch Portraits cannot retrieve the portrait, and you will not be entitled to a refund. In the rare event that your commissioned artwork is dispatched to a different address than the one you entered, you will be eligible for a full refund or a replica portrait. All artworks are meticulously packaged and insured to the full amount in the UK (for worldwide orders, rest assured that I will replace any artwork damaged in transit). While every effort is made to deliver your custom pet portraits on or around the date specified by the courier, Cush's Sketch Portraits is not responsible for any delays. Should your parcel go missing, a claim for compensation will be filed for the total cost of your order. Refunds will only be processed after the courier accepts the claim, which may require you to fill out a form confirming non-receipt. This process could take a few weeks. Once the compensation is received, you will be issued a full refund (please refer to the cancellation section for refund details). I will keep you updated on this process if necessary.
All commissioned artwork is non-refundable as these custom pet portraits are made to order. In the unlikely event that your artwork arrives damaged, you must take photographs of the damage/s and send them to me within 3 days of receiving the parcel. I will then initiate the process of claiming compensation from the courier using your photos. Refunds or replacements will only be issued after the courier has accepted the claim, as they may require you to fill out a form declaring that the artwork arrived damaged - this process could take a few weeks. As soon as the compensation amount has been received, you will be issued a full refund or replacement (please see the cancellation section for more information). You will be contacted with any necessary updates on this process.
Gift vouchers for commissioned artwork are dispatched within 3 working days of purchase. Please note that gift vouchers cannot be redeemed for cash and have a validity of 1 year. Each gift voucher is worth the specified amount and currency written on it, which can only be applied towards commissions. As prices for portraits can change at any time, I recommend that you claim your gift voucher as soon as possible after receiving it to avoid potential price increases after the purchase.
Prices for commissioned artwork can change at any point, typically reflecting the rising costs of quality materials used, the increase in material costs, and advancements in professional skill.
